POCSO QUASH BASED ON COMPROMISE – KEY POINTS TO UNDERSTAND

Can a POCSO case be compromised and quashed? YES. But what are some of the key points one must know while dealing with such quash matters?

To begin with, are POCSO quash matters to be dealt on the same footing if the accused is of an age much above that of the minor victim, and they claim to have had a “consensual relationship”? Can POCSO case be quashed if the accused has committed such POCSO offence not due to any teen relationship, but has later compromised the matter by marrying the victim? Can it be treated on par with the scenario where the parties were in a teenage relationship? What if both the parties are minors, and the marriage is void as per the law applicable to the parties? Will the validity of the marriage be taken into question while considering a quash petition filed by the parties based on such marriage? All these questions are answered by the Author in an article published in the Lawyers’ Society Digital Law Magazine – July 2024. You can purchase the same at just Rs. 50/-!
